DLS CHARGE 5 DAYS AFTER GUILTY PLEA

GEORGIA: Vermont State Police arrested Robert Mackenzie, 62, of Georgia on Saturday, January 14th, just days after he plead to two DUI charges stemming from October and November incidents.

According to Trooper Rolandi, Mackenzie was arrested Saturday after originally being pulled over for an equipment violation while driving on Ballard Road in the Town of Georgia.

oUntil last Monday’s plea agreement, Mackenzie was facing DUI #1 and DUI #2 charges. The plea deal meant that Mackenzie’s DUI #1 charged would be dropped to a Careless and Negligence Charge, while the DUI #2 charge would be dropped to DUI #1.

Under the plea deal, Mackenzie was sentenced to 4-24 months, all suspended. If a judge decides, Saturday’s DLS charge may turn into a to-serve sentence, if he is convicted on Saturday’s DLS charge.

Mackenzie’s lawyer, Michael Ledden, told Judge Gregory Rainville “He has been going through some personal life trauma, not in a medical nature, but his family life is not going smoothly at the time” as he tried to get Rainville to go easy on Mackenzie.

“He has been sober now since November 20th,” Ledden told the Judge, “He has full intentions… that as soon as he can get into CRASH, he wants to take advantage of the interlock.”

His plea agreement included alcohol screening and counseling, 50 hours of community service, and must not operate a motor vehicle without a valid driver’s license.

The 62-year-old man is currently being supervised by St. Albans Department of Probation and Parole. He is due in court on the DLS charge on February 13th.
