BERKSHIRE MAN SENTENCED TO 4-10 YEARS ON ASSAULT CHARGES

ST. ALBANS: Judge Gregory Rainville said in no uncertain terms on Friday that the prison term for Timothy Edgerly, 30, of Berkshire, would be harsh, due to a lack of understanding that Edgerly has shown for his actions.

Edgerly was being sentenced in connection with an assault on his girlfriend as well as a bystander that tried to stop the initial assault. He plead guilty in a plea agreement on October 2nd to the charges.

According to his court file, Edgerly physically and vocally assaulted the victim, but it wasn’t until the victim jumped from Edgerly’s moving vehicle that the case became public.

On June 19th, the victim was seen by a passing motorist, who stopped to assist the victim, who was holding onto a guardrail while Edgerly was hitting and choking the victim.

The County Courier has a policy, in general, not to name victims or witnesses in assault cases.

According to the witness, Edgerly then turned his anger toward the victim when she tried to intercede.

“While he was choking me at some point I was unable to breathe. I was scared for my life. I was scared and thinking he’s going to kill me and my kids are going to have nobody, I just wanted it to stop,” the victim wrote in an affidavit.

According to the court file, the victim sustained a broken ankle from jumping out of the moving vehicle. She says the pain affects her on a daily basis.

Court records paint a picture of a dark relationship between the victim and Edgerly.

According to the victim, Edgerly would emotionally abuse her, calling her a “nasty and dirty woman,” a “whore,” and would make her strip naked in order to demean her body.

“I couldn’t even go to the bathroom without him standing at the door,” the victim said, “Tim is not the person he claims to be. He is a smooth talker and makes you believe.”

“This is one of the worst I’ve ever seen,” Rainville said, “I’ve been on the bench for 10 years, this is in the top two or three.”

According to the victim in the case, Edgerly had assaulted her at least one other time in 2012.

Rainville told Edgerly that even though this was the first time that he had been through the court system for an assault, his behavior was very disturbing.

“You have no idea the impact you have had on your child,” Rainville told Edgerly during the sentencing process.

According to the affidavit, Edgerly had his child in the vehicle at the time; that child witnessed the assault.

Pictures entered into evidence in the case shows a bruised and battered victim in the hours after the assault.

Rainville also noted that Edgerly’s case was different that most defendants with the same or similar charges, in the sense that most defendants’ behavior was preceded by drug or alcohol abuse, whereas Edgerly was sober when the offense occurred.

Rainville sentenced Edgerly to 4-10 years for the Domestic Assault charge, and 90 days to one year on the Simple Assault charge, to be served consecutively. That will essentially mean that Edgerly will see a total prison term of four years and three months up to 10 years and three months.

According to Edgerly’s record, he has been charged with 16 other charges in his lifetime, being convicted of 10 of those charges.

Because Edgerly has been held in prison since his June 19th arrest, he’ll be eligible for release on September 17th, 2020.
