TWO CHARGED IN CONNECTION WITH TEEN’S FATAL CRASH

Vermont State Police have filed charges on two Franklin County men in connection with a fatal DUI crash in Berkshire last month.

According to Trooper Christopher Hein, an investigation into the crash that killed 16-year-old Carson Smith of Berkshire, lead police to 22-year-old Jon Schurger of St. Albans City, and 22-year-old Dylon Smith of Enosburgh.

According to a written statement by Trooper Hein, Schurger is facing the charges of Sale or furnishing to minors and enabling consumption by minors causing death or serious bodily injury. Dylon Smith is now facing a charge of being an accessory in aiding in the commission of a felony.

“As a result of this investigation, it was discovered Carson Smith along with several other juveniles attended an underage drinking party on Berry Road in the town of Richford,” Trooper Hein wrote, “Witness statements and video footage has shown Jon Schurger purchased the alcohol for the party from a retail establishment in Enosburgh and was aided by Dylon Smith, who was also present.”

The Trooper said Carson Smith, who died as a result of the crash, was intoxicated and may have been impaired by a substance other than alcohol, according to the Chief Medical Examiner’s report.

Both men were taken into custody on Thursday afternoon and processed for the charges. That included mug shots being taken and the men having their fingerprints documented.

If convicted, the charge for enabling consumption to a minor with death resulting could lead to Schurger being sentenced to up to five years in prison and a fine of up to $10,000.

Dylon Smith, being charged as an accessory, could see the same sentence as Schurger if convicted.

The Trooper said the investigation included members of the State Police Field Force, Bureau of Criminal Investigations, and detectives with the Vermont Department of Liquor Control.

According to police, Carson Smith crashed his 2004 Toyota Tundra around 4:45 am on June 8th. When first responders arrived, they found the white Tundra off the southbound shoulder of the highway. Carson Smith was found to be the operator and sole occupant of the vehicle when the crash occurred, ejecting him in the process.
